Florida Statutes provide that if a person’s criminal record contains certain dangerous crimes, such crimes, even if you received a withhold of adjudication, cannot be expunged, nor can the criminal record be sealed. However, if you were charged or arrested for any of those offenses and you were found not guilty at trial or those charges were later abandoned, dismissed or dropped you remain eligible to have your criminal record history sealed or expunged.
DISQUALIFYING CHARGES FOR SEALING OR EXPUNGING CRIMINAL RECORD
A request for a certificate of eligibility for sealing or expunging a criminal history record will be denied and you will be unable to seal or expunge your criminal history record if you have been found guilty or pled guilty or no contest, even if you received a withhold of adjudication, on any violation of the following:
