Penalties
Florida Statute 893.13(2)(a) states that it is unlawful for any person to purchase, or possess with intent to purchase certain controlled substances.
For the most part, an offense of Sale or Delivery of a controlled substance is either a second or third degree felony, however the sale and delivery of a limited number and quantity of certain controlled substances is first degree misdemeanor. Below is a listing of penalties associated with crimes related to the sale, manufacture or delivery of commonly known “controlled substances.”
Second Degree Felony
If you are charged with the purchase or possession with intent to purchase any of the below mentioned drugs it is a second degree felony with a maximum possible penalty of 15 years in state prison or 15 years of state supervised probation and/or up to a $10,000 fine.

First Degree Misdemeanor
