Expunging your Florida Criminal Record History
Subject to a few
exceptions,
having your criminal record expunged gives you the right to deny
ever having been arrested or charged with a crime.
What Happens
When Your Criminal Record is Expunged
When the court
grants a petition to expunge it will then order that your criminal
record be physically
destroyed. The court order will direct the courts, state
attorney’s office and law enforcement agencies that possess either a
physical or electronic record related to your expungement petition
to physically destroy them. However, one copy of your record is retained by the Florida Department of
Law Enforcement and that copy is
not viewable by anyone
without court order. It
is a first degree misdemeanor for law enforcement or other related
agencies to even say that you had a record sealed or expunged.
As with sealing, information regarding your arrest or charge
will be removed from the Criminal Justice Information System (CJIS)
so that it WILL NOT COME
UP ON ANY BACKGROUND CHECKS.
Expunction of a Criminal Record Has Five Effects:

The criminal record is
physically destroyed.

The criminal record is physically unavailable and
unobtainable by the general public, including future employers
or other prying eyes;

The individual may lawfully deny or fail to acknowledge the
expunged criminal incident;

The individual does not commit or make
a false statement by failing to acknowledge the expunged
criminal incident;
-
Information relating to the expunged
criminal incident is confidential.

sealed criminal activity is not confidential, and the individual may
not lawfully deny or fail to acknowledge the sealed incident)
