Overview
In Florida, your home is your castle. The Florida legislature has
taken a strong position against home robbery.
Accordingly, any type of home invasion robbery is classified
as a first degree felony. F.S. 812.135 defines “home-invasion
robbery” as “any robbery that occurs when
the offender enters a
dwelling with the
intent to commit a robbery, and does commit a robbery of the
occupants therein.
Penalties
Home invasion
robbery can carry severe penalties and depending on the
circumstances can carry increased or enhanced penalties. Generally,
the penalties for home invasion robbery are as follows:
- Home Invasion Robbery,
felony of the first
degree, if carried
firearm or other
deadly weapon,
punishable by imprisonment for a term of years not exceeding
life imprisonment
as provided in F.S. 775.082, s.
775.083,
or s. 775.084;
- Home Invasion Robbery,
felony of the first
degree, if carried a
weapon, is a,
punishable as provided in F.S.
775.082, s.
775.083,
or s. 775.084;
- Home Invasion Robbery,
felony of the first
degree, if
without firearm,
deadly weapon or other weapon, punishable as provided in F.S.
775.082, s.
775.083,
or s. 775.084.
